According to the industry charity, calls regarding TUPE regulations surged by 220% last year and continue to soar.
A chaotic industry ecosystem is having a significant impact on talent as employees navigate rapid account moves.
According to NABS calls related to TUPE, the legislation which protects UK employees' rights when a business or part of a business or service moves from one organisation to another, rose by 220% last year and continue to soar.
TUPE, which stands for Transfer of Undertakings (Protection of Employment) Regulations, traditionally occurs in the advertising industry when significant account moves take place.
NABS revealed that calls to the service to date have clustered around three core issues. Firstly, employees are facing unclear or inconsistent information from one or both companies. Secondly, many have shared they feel powerless in the process. While the third issue is the widespread concern over what the transfer might mean in practice; whether in relation to culture, job security, career development and longer-term prospects.
The growth of TUPE is a new yet rapidly growing trend as the industry changes at pace.

The NABS team underlines that going through TUPE can be emotionally taxing. It often brings uncertainty and a feeling of having little control over what comes next. This can leave people feeling anxious, low in mood or struggling to stay motivated. It’s also common to grieve what’s being left behind: familiar colleagues, ways of working, or a sense of belonging.
TUPE is a complex piece of legislation and so the NABS guide provides a welcome and practical introduction to the process. The guide is an essential first port of call for those facing TUPE, providing an overview of employee rights as well as what to expect from the process.
Lorraine Jennings-Creed, Director of Wellbeing Services and Culture Change at NABS, explains “The growth of TUPE is a new yet rapidly growing trend as the industry changes at pace. This NABS guide offers relevant and up to date information, breaking down what can be a complex and worrying process into something that can be better understood and navigated.”
She continued: “NABS is here to be a sounding board throughout the process, so to anyone facing TUPE, we encourage them to visit the guide and then to call us for more guidance and support if they need it.”
